An email provider reportedly used by former NSA contractor Edward Snowden shut down on Thursday, citing an ongoing court battle that it could not discuss.
Lavabit, which launched in 2004, specialized in providing a high-security email service that employed advanced encryption. It was designed to thwart the kind of surveillance techniques that Snowden revealed in June were used by the U.S. government.
Snowden used a Lavabit email address to invite people to a press conference at Sheremetyevo Airport in Moscow on July 12, according to a report from the international wire service Global Post.
Lavabit founder Ladar Levison wrote that he couldn’t describe the legal machinations under way. “As things currently stand, I cannot share my experiences over the last six weeks, even though I have twice made the appropriate requests,” he wrote in a front-page notice on his website.
Levison wrote that Lavabit has “started preparing the paperwork needed to continue to fight for the Constitution in the Fourth Circuit Court of Appeals. A favorable decision would allow me to resurrect Lavabit as an American company.”
Kurt Opsahl, senior staff attorney with the Electronic Frontier Foundation, said in an interview that there are many statutes that could be used by the government to prevent Lavabit from describing its legal situation.
“What we need here is more transparency to have a real debate around government surveillance powers,” Opsahl said. “It would be great to have Lavabit to be able to participate in a national discussion we are having right now on surveillance powers.”
(Lavabit) E-mail is encrypted before it is sent to the company’s servers. The result of the encryption process means that a message is, in theory, cryptographically impossible to read without a password, Lavabit wrote.
“We say cryptographically impossible because, in theory, an attacker with unlimited computing resources could use brute force to decipher the original message,” according to the description.
It appears from the description that Lavabit only retains a Secure Hash Algorithm (SHA) representation of a person’s password. The hash, even if it was obtained by investigators with a court order, would likely not be of use to investigators seeking to decrypt Snowden’s email.
Lavabit warned that the encryption’s strength also relies heavily on a secure password selected by a user. Attackers could also intercept a message in transit if SSL (Secure Sockets Layer) encryption is not used for the communication between a user and Lavabit’s servers. Unencrypted messages could also be potentially pulled from a user’s hard drive.

The email service offered various security features to a claimed user base of 350,000, and is the first such firm to have publicly and transparently closed down, rather than cooperate with state surveillance programs.
Several technology companies that participate in the National Security Agency's surveillance dragnets have filed legal requests to lift the secrecy restrictions that prevent them from explaining to their customers precisely what it is that they provide to the powerful intelligence service – either wittingly or due to a court order. Yahoo has sued for the disclosure of some of those court orders.
The presiding judge of the secret court that issues such orders, known as the Fisa court, has indicated to the Justice Department that he expects declassification in the Yahoo case. The department agreed last week to a review that will last into September about the issues surrounding the release of that information.
There are few internet and telecommunications companies known to have refused compliance with the NSA ... One of them is Qwest Communications, whose former CEO Joseph Nacchio – convicted of insider trading – alleged that the government rejected it for lucrative contracts after Qwest became a rare holdout for post-9/11 surveillance.
"Without the companies' participation," former NSA codebreaker William Binney recently told the Guardian, "it would reduce the collection capability of the NSA significantly."

Lavabit Encrypted Email Service Shuts Down, Can’t Say Why:
Given the impressive powers of the government to obtain emails and records from service providers, both with and without legal authority, it is encouraging to see service providers take steps to limit their ability to access user data, as Lavabit had done.
But now it’s gone.
It’s rare to see an email provider choose to go out of business rather than compromise its values. It must have been a hard decision for Ladar Levison, but he remained true to his promise to put privacy before profits. It was also hard on the users, some of whom lost access to email not available elsewhere.
Lavabit's ominous note and the lack of information about this case is especially concerning for users of large communication service providers like Facebook and Google that may well have been subject to similar pressure, and we hope they will continue to fight for the user in the face of government demands, even if not recognized for years. Already, Lavabit's note has led to Silent Circle dropping its email service, saying "We see the writing [on] the wall, and we have decided that it is best for us to shut down Silent Mail now. We have not received subpoenas, warrants, security letters, or anything else by any government, and this is why we are acting now."
Moving forward, we need more transparency so the public can know and understand what led to a ten-year-old business closing its doors and a new start-up abandoning a business opportunity. Hopefully Congress will get concerned, especially when there are American jobs at stake.

Lavabit email service abruptly shut down citing government interference:
Silent Circle, another provider of secure online services, announced on later Thursday night that it would scrap its own encrypted email offering, Silent Mail.
Silent Circle said in a blogpost that although it had not received any government orders to hand over information, "the writing is on the wall".
Privacy advocates called the moves unprecedented. "I am unaware of any situation in which a service provider chose to shut down rather than comply with a court order they felt violated the constitution," said Kurt Opsahl, a lawyer with the Electronic Frontier Foundation.
The justice department said it had no comment to make. Representatives from the NSA, White House and the Office of the Director of National Intelligence did not immediately reply to a request for comment.

Lavabit went dark Thursday, after nearly 10 years in service. Lavabit is the Web mail service allegedly used by Edward Snowden to contact a Human Rights Watch representative in July. Snowden is the source of the recent unsettling revelations about National Security Agency surveillance activity.
Levison, a San Francisco native and an enthusiastic beach-and-sand volleyball player who moved to Texas to go to college, currently resides in Dallas. He founded Lavabit in 2004 following his graduation from Southern Methodist University a few years earlier.
In an phone interview with CNET and Jesse Binnall, Levison's Virginia-based attorney, about the decision to shutter Lavabit, Levison spoke about the connection between Lavabit and the Patriot Act, how he thinks the laws regarding privacy ought to change, and how the American government is failing to uphold the U.S. Constitution.
What's the key issue here? Why did you shut down Lavabit?
Levison: For me it wasn't about protecting a single user, but protecting the privacy of all my users, coupled with the fact that I wasn't able to discuss it publicly.
I believe that people have the right to know what their government is doing. I had an issue with me doing what they wanted me to do without them disclosing it.
We've had a couple of dozen court orders served to us over the past 10 years, but they've never crossed the line...
Until now?
Levison: I can neither confirm nor deny "until now." Are you familiar with the case of Aaron Swartz, familiar with the accusations of prosecutorial misconduct? There may be parallels between that case and this.
What's worse is that I can't tell you what that abuse was.

Just the idea of secret laws, so to speak, bothers me tremendously. That should almost be a constitutional change.
We've shown that some of our most important freedoms can't be trusted to Congress, they need to be placed in the Constitution. Going beyond that, as an Internet service provider, there needs to be a more clear definition of our protections.
Right now, as a third-party litigation, we effectively have no rights. There's no legal framework that we can fight with or against anything that is unjust. They're abusing their secrecy to hide their surveillance methods.
I think that there's a lot more that will come out, and that needs to come out. I obviously can't tell you what was happening and what I know, and I was uncomfortable with it. I'd rather shut down my service and my primary source of income than be complicit in crimes against the American people.
How did the Patriot Act influence your e-mail service?
It played a big role in how I designed the custom platform. All I needed when somebody registers was a name and a password. I didn't need a real name, address, social security number, credit card number... Why should I collect that info if I didn't need it? [That philosophy] also governed what kind of information I logged.
The current administration is not being transparent and open about what it is they're doing, even to members of Congress.
How have Lavabit's users reacted?
Levison: It's overwhelmingly positive. Some of them are understandably frustrated that I had to shut down without notice. I lost my one and only e-mail account over the past 10 years, as well. I feel my decision was the lesser of two evils.
What happens to your customer's e-mails and data?
Levison: I'm looking into setting up a site where users can download their data and set up a forwarding [e-mail] address, but that may take a week or two to set up. That's all I can do until I feel confident that I can resume the service without having to compromise its integrity.
I will make it clear that I don't plan to use any encryption for that site. [People] should only use it if they feel comfortable with the information being intercepted. And yes, I do plan to have that disclaimer on the site.
Unfortunately, what's become clear is that there's no protections in our current body of law to keep the government from compelling us to provide the information necessary to decrypt those communications in secret.
I'm still looking at seeing if that's even logistically feasible -- there's half a billion messages [sent in the 10 years Lavabit operated]. By shutting down the service, I will be losing the infrastructure that I used to support all those people.
Levison: Lavabit at the time of the shutdown had 410,000 users, with 40,000 weekly log-ins, 200,000 e-mails sent a day -- 1.4 million e-mails a week.
We were in a very narrow category of what I like to call medium-sized providers. Once you get over the 50,000 to 100,000 user threshold, e-mail becomes a very difficult problem of scale. It's why you see so many e-mail providers come and go.

An email provider reportedly used by former NSA contractor Edward Snowden shut down on Thursday, citing an ongoing court battle that it could not discuss.
Lavabit, which launched in 2004, specialized in providing a high-security email service that employed advanced encryption. It was designed to thwart the kind of surveillance techniques that Snowden revealed in June were used by the U.S. government.
Snowden used a Lavabit email address to invite people to a press conference at Sheremetyevo Airport in Moscow on July 12, according to a report from the international wire service Global Post.
Lavabit founder Ladar Levison wrote that he couldn’t describe the legal machinations under way. “As things currently stand, I cannot share my experiences over the last six weeks, even though I have twice made the appropriate requests,” he wrote in a front-page notice on his website.
Levison wrote that Lavabit has “started preparing the paperwork needed to continue to fight for the Constitution in the Fourth Circuit Court of Appeals. A favorable decision would allow me to resurrect Lavabit as an American company.”
Kurt Opsahl, senior staff attorney with the Electronic Frontier Foundation, said in an interview that there are many statutes that could be used by the government to prevent Lavabit from describing its legal situation.
“What we need here is more transparency to have a real debate around government surveillance powers,” Opsahl said. “It would be great to have Lavabit to be able to participate in a national discussion we are having right now on surveillance powers.”
(Lavabit) E-mail is encrypted before it is sent to the company’s servers. The result of the encryption process means that a message is, in theory, cryptographically impossible to read without a password, Lavabit wrote.

It appears from the description that Lavabit only retains a Secure Hash Algorithm (SHA) representation of a person’s password. The hash, even if it was obtained by investigators with a court order, would likely not be of use to investigators seeking to decrypt Snowden’s email.
Lavabit warned that the encryption’s strength also relies heavily on a secure password selected by a user. Attackers could also intercept a message in transit if SSL (Secure Sockets Layer) encryption is not used for the communication between a user and Lavabit’s servers. Unencrypted messages could also be potentially pulled from a user’s hard drive.

The email service offered various security features to a claimed user base of 350,000, and is the first such firm to have publicly and transparently closed down, rather than cooperate with state surveillance programs.
Several technology companies that participate in the National Security Agency's surveillance dragnets have filed legal requests to lift the secrecy restrictions that prevent them from explaining to their customers precisely what it is that they provide to the powerful intelligence service – either wittingly or due to a court order. Yahoo has sued for the disclosure of some of those court orders.
The presiding judge of the secret court that issues such orders, known as the Fisa court, has indicated to the Justice Department that he expects declassification in the Yahoo case. The department agreed last week to a review that will last into September about the issues surrounding the release of that information.
There are few internet and telecommunications companies known to have refused compliance with the NSA ... One of them is Qwest Communications, whose former CEO Joseph Nacchio – convicted of insider trading – alleged that the government rejected it for lucrative contracts after Qwest became a rare holdout for post-9/11 surveillance.
"Without the companies' participation," former NSA codebreaker William Binney recently told the Guardian, "it would reduce the collection capability of the NSA significantly."

Lavabit Encrypted Email Service Shuts Down, Can’t Say Why:
Given the impressive powers of the government to obtain emails and records from service providers, both with and without legal authority, it is encouraging to see service providers take steps to limit their ability to access user data, as Lavabit had done.
But now it’s gone.
It’s rare to see an email provider choose to go out of business rather than compromise its values. It must have been a hard decision for Ladar Levison, but he remained true to his promise to put privacy before profits. It was also hard on the users, some of whom lost access to email not available elsewhere.
Lavabit's ominous note and the lack of information about this case is especially concerning for users of large communication service providers like Facebook and Google that may well have been subject to similar pressure, and we hope they will continue to fight for the user in the face of government demands, even if not recognized for years. Already, Lavabit's note has led to Silent Circle dropping its email service, saying "We see the writing [on] the wall, and we have decided that it is best for us to shut down Silent Mail now. We have not received subpoenas, warrants, security letters, or anything else by any government, and this is why we are acting now."
Moving forward, we need more transparency so the public can know and understand what led to a ten-year-old business closing its doors and a new start-up abandoning a business opportunity. Hopefully Congress will get concerned, especially when there are American jobs at stake.

Lavabit email service abruptly shut down citing government interference:
Silent Circle, another provider of secure online services, announced on later Thursday night that it would scrap its own encrypted email offering, Silent Mail.
Silent Circle said in a blogpost that although it had not received any government orders to hand over information, "the writing is on the wall".
Privacy advocates called the moves unprecedented. "I am unaware of any situation in which a service provider chose to shut down rather than comply with a court order they felt violated the constitution," said Kurt Opsahl, a lawyer with the Electronic Frontier Foundation.
The justice department said it had no comment to make. Representatives from the NSA, White House and the Office of the Director of National Intelligence did not immediately reply to a request for comment.

Lavabit went dark Thursday, after nearly 10 years in service. Lavabit is the Web mail service allegedly used by Edward Snowden to contact a Human Rights Watch representative in July. Snowden is the source of the recent unsettling revelations about National Security Agency surveillance activity.
Levison, a San Francisco native and an enthusiastic beach-and-sand volleyball player who moved to Texas to go to college, currently resides in Dallas. He founded Lavabit in 2004 following his graduation from Southern Methodist University a few years earlier.
In an phone interview with CNET and Jesse Binnall, Levison's Virginia-based attorney, about the decision to shutter Lavabit, Levison spoke about the connection between Lavabit and the Patriot Act, how he thinks the laws regarding privacy ought to change, and how the American government is failing to uphold the U.S. Constitution.
What's the key issue here? Why did you shut down Lavabit?
Levison: For me it wasn't about protecting a single user, but protecting the privacy of all my users, coupled with the fact that I wasn't able to discuss it publicly.
I believe that people have the right to know what their government is doing. I had an issue with me doing what they wanted me to do without them disclosing it.
We've had a couple of dozen court orders served to us over the past 10 years, but they've never crossed the line...
Until now?
Levison: I can neither confirm nor deny "until now." Are you familiar with the case of Aaron Swartz, familiar with the accusations of prosecutorial misconduct? There may be parallels between that case and this.
What's worse is that I can't tell you what that abuse was.

Just the idea of secret laws, so to speak, bothers me tremendously. That should almost be a constitutional change.
We've shown that some of our most important freedoms can't be trusted to Congress, they need to be placed in the Constitution. Going beyond that, as an Internet service provider, there needs to be a more clear definition of our protections.
Right now, as a third-party litigation, we effectively have no rights. There's no legal framework that we can fight with or against anything that is unjust. They're abusing their secrecy to hide their surveillance methods.
I think that there's a lot more that will come out, and that needs to come out. I obviously can't tell you what was happening and what I know, and I was uncomfortable with it. I'd rather shut down my service and my primary source of income than be complicit in crimes against the American people.
How did the Patriot Act influence your e-mail service?
It played a big role in how I designed the custom platform. All I needed when somebody registers was a name and a password. I didn't need a real name, address, social security number, credit card number... Why should I collect that info if I didn't need it? [That philosophy] also governed what kind of information I logged.
The current administration is not being transparent and open about what it is they're doing, even to members of Congress.
How have Lavabit's users reacted?
Levison: It's overwhelmingly positive. Some of them are understandably frustrated that I had to shut down without notice. I lost my one and only e-mail account over the past 10 years, as well. I feel my decision was the lesser of two evils.
What happens to your customer's e-mails and data?
Levison: I'm looking into setting up a site where users can download their data and set up a forwarding [e-mail] address, but that may take a week or two to set up. That's all I can do until I feel confident that I can resume the service without having to compromise its integrity.
I will make it clear that I don't plan to use any encryption for that site. [People] should only use it if they feel comfortable with the information being intercepted. And yes, I do plan to have that disclaimer on the site.
Unfortunately, what's become clear is that there's no protections in our current body of law to keep the government from compelling us to provide the information necessary to decrypt those communications in secret.
I'm still looking at seeing if that's even logistically feasible -- there's half a billion messages [sent in the 10 years Lavabit operated]. By shutting down the service, I will be losing the infrastructure that I used to support all those people.
Levison: Lavabit at the time of the shutdown had 410,000 users, with 40,000 weekly log-ins, 200,000 e-mails sent a day -- 1.4 million e-mails a week.
We were in a very narrow category of what I like to call medium-sized providers. Once you get over the 50,000 to 100,000 user threshold, e-mail becomes a very difficult problem of scale. It's why you see so many e-mail providers come and go.
